Question : Must a retail store disclose an item as having been refurbished
I have just purchased a digital camera, from a local, family-owned place, here in NYC. I asked about the cameras they had on display, their return policy, which is "no refund,""exchanges within 7 days." I chose a Polaroid i835, which, with a 1g memory chip, came out to 120 dollars. I figured the cameras they sold were new and, if I needed to exchange it, it'd be fine because I'd be able to exchange it for a different new item. However, when I took it home, I saw a small "refurbished item" sticker on the box. I also saw a refurbished warranty inside. The camera itself had a few very superficial scratches, on the metallic parts and the lcd screen, as well as some dirty spots. The price, itself, is not that bad, but I wanted a new item, not a refurbished one, and feel the business acted unethically. Would anyone know if, based on the salesman's failure to disclose the condition of the item, I would be entitled to a refund, regardless of their sales policy, when I go back to try to return it tomorrowTo Adam, he showed me a display model and then pulled out a box from a stack and bagged it for me. I only got to see the box, up close, when I got home.BuniWabit, thanks for your reply. I don't think you're ranting. These stores obviously get around, which is why we both have issues with them. I hope you got your money back. I'm just pissed at the dishonesty. If I want refurbished items, I'm glad to pay for them; but I want to know an item is refurbished. After all, no one goes to a store expecting to be sold refurbished, used goods. Thanks, again, and, for the record, I hate NYC: I'm the sort of person that lacks quiet, solitude and close, sincere friends. Take care- Marty.EDIT: I meant to say, in the last post, "likes close friends and solitude."
Answer:
Most states have very specific laws about this kind of thing, mostly along the lines that the item must be prominently marked as refurbished, or there must be a disclosure made. I'm not sure about the specifics in NY state. Here's a link to the NY state Consumer Protection Board.
